Today # 20N is the day that commemorates trans people who are victims of transphobia and hatred, those who have taken their lives 🏳️⚧️
We insist to the government that the #LeyTrans and #LGTBI cannot be delayed any longer❌
In connection with this date, we want to share three reflections as a result of some aspects of the last report on the Right to Gender Self-Determination that we have carried out together with the law firms of @Dentons @DLAPiper @marvalofarrell and @dechertllp_ 📝
1️⃣👩🏾💻We need simple, accessible procedures and guarantees for migrants. Including people in an irregular administrative situation.
✊🏿 Any trans migrant person with habitual residence in Spain must be able to change the documentation that Spain recognizes.
2️⃣ Previous drafts of the #LeyTrans included at least the possibility of eliminating the mention of sex in DNI🤦🏽♀️
⚠️ The current absence of this measure is a great weakness; legislative evolution in our societies is moving towards the recognition of non-binary identities
3️⃣ The right to self-determination must be extended to ALL minors, as it happens in Norway ✊🏽
👩🏽⚖️ We remember that there is a Constitutional Court ruling in Spain (STC 99/2019, July 18, 2019) that recognizes the rights of minors to the rectification record.
☑️ This report was one of the tools we used to advocate for trans rights, with the knowledge and the guarantee that Spain will advance in line with the legislation of other countries.
